Each dispute is unique. Therefore, the style of mediation is tailored to the dispute. The parties with their attorneys are encouraged to determine which style of mediation they prefer and to communicate this to the mediator. A facilitative approach may be appropriate in disputes where continuing relations are important or necessary to the parties after the dispute has been resolved. The facilitative approach permits the parties to express their feelings while addressing the possible solutions to the dispute. An evaluative approach tends to concentrate on the facts of the dispute, generate possible solutions and solution options until a resolution to the dispute is reached. In many cases, a blend of styles is used to cover the various issues that comprise the dispute in order to reach resolution of the dispute.
Generally, all of the parties meet collectively at the beginning of the mediation session. Thereafter, separate discussions (caucusing) with the individual parties may be desired to allow a more detailed understanding of the issues. These discussions may include various questions regarding the strengths and weaknesses of each party’s case and their expectations with regard to potential outcomes of the dispute. The purpose of this process is not to make anyone feel uncomfortable. Rather, the purpose is to help people evaluate their position. This process does not involve the mediator expressing an opinion of the merits of a given argument.
Everyone's time is valuable. Before mediation, it is recommended that counsel for each party submit a summary of the issues and pertinent documentation detailing and supporting their client’s position. This information should be submitted no less than two (2) business days before the scheduled mediation. This provides the mediator an opportunity to evaluate the specific issues relating to the claim(s) and to develop insight into the parties' positions. This saves valuable time during the mediation, which can be put to better use assisting the parties in resolving their differences.
